Course Description:
As the use of Social Media explodes, the legal implications in the workplace continue to develop. This session will heighten your understanding of the legal issues surrounding social media.
A. Recruiting: Do the benefits outweigh the pitfalls of incorporating website (Facebook, MySpace, etc.) searches into your background checks? A discussion of how such practices implicate FCRA, ADA, ADEA, PHRA, Title VII, NLRA.
B. Monitoring: What ever happened to free speech??? Privacy??? What does off-duty conduct have to do with my job???
C. Discipline/Termination: Making adverse employment decisions on the basis of information posted by an employee or when an employee engages in social networking during work hours.
D. Policies: How can an employer avoid (or at least minimize) liability? Anti-Discrimination Policy; Equal Employment Opportunity Policy, Recruitment Policy; Electronic Resources Policy; Internet Postings Policy; Trademark/Copyright Policy.
